Evidence of date rape drug is thrown out of military trial
ANNAPOLIS, Md. -- Evidence that a female Naval Academy midshipman was given a date rape drug near the time of an alleged assault will NOT be heard at the special court martial of the midshipman charged in the attack. Kenny Ray Morrison of Kingwood, Texas, is charged with indecent assault, indecent acts and conduct unbecoming an officer in the Feb. 4 incident. The senior and former football player has pleaded NOT guilty. Lieutenant Colonel Paul McConnell, a Marine Corps judge, threw out the toxicology test result yesterday after testimony at the Washington Navy Yard. McConnell says the result could prove that the drug G-H-B was in the woman's system during a six-week period but could NOT be linked to Morrison. Morrison will face NO jail time if convicted in the special court-martial, a midlevel form of military trial that's often used for misdemeanors.
