'Nicole' attacks alleged rapist before hearing

One of four US marines accused in the Subic rape case was attacked by the complainant before the start of Monday's hearing at a Makati court. “Nicole" reportedly hit Lance Cpl. Daniel Smith with her bag as she was walking toward the witness stand to continue her testimony before Judge Benjamin Pozon around 1 p.m. ABS-CBN reporter Ina Reformina said the complainant's mother claimed that Smith tried to trip her daughter. Embassy personnel quickly transferred Smith to another bench inside the courtroom after the commotion. Evalyn Ursua, the complainant's lawyer, brought Nicole to the ladies' rest room.
