Cultural rape used as legal tool

DEFENCE lawyers were in part to blame for perpetuating the myth that rape was acceptable in Aboriginal culture, an Aboriginal professor of law said. Larissa Behrendt, professor of law at the University of Technology, Sydney, and a prize-winning author, said the cultural law defence was being concocted, even to the present day, and accepted by judges. The practice was damaging to the rights of victims, she said. Professor Behrendt was speaking after a week of agonising over shocking allegations of rape and sexual abuse in some Aboriginal communities, even rape of babies. She said the cultural defence had arisen in cases in which Aboriginal men had been accused of sexual assault. .
